This tripartite initiative between government-industry-NGOs pivots on three preventative strategies namely, enhanced public health measures, early detection testing regime and health education. So STFC doesn’t just talk but rolls out programmes, mass testing, POIS, procuring vaccines, etc, to end the pandemic...

‘At the end of the day, we are in it together. If we refuse to learn from each other and operationalise the best public health practices, we are in for a rough ride.

‘I hope the national task force, as petitioned by the 46 top physicians, is rapidly recognised, accepted, and formalised to empower it to immediately re-strategise and transform the mindset, and policy at the top end of the Health Ministry, so that the operations at ground zero will be a truly rapid-response FTTIS which has zero-tolerance for cases, clusters or outbreaks.

‘MCOs are the blunt tools of those who have failed to operationalise the back-to-basics of pandemic management and in my opinion, they should either seek a second opinion from the task force and/or gracefully exit to minimise further harm to the nation and allow the task force to steer the nation out of this Covid-19 conundrum and to protect the lives and livelihood of its rakyat.’

Vaccines were a chance to redeem failures in the US coronavirus response. What went wrong?

‘The delayed and disjointed vaccine rollout is the product of poor coordination between the federal government and the 50 states and additional jurisdictions tasked with carrying out the most ambitious immunization campaign in history, likened by officials to the effort to turn back the Nazis in 1944.

‘With these problems thwarting the rollout, it is clear the United States has not learned from its fractured pandemic response and risks repeating some of the same errors.

“My peers in infectious-disease medicine and public health are all looking around saying, ‘How are you all handling these issues? What happens when we get airdropped vaccines? Who gets it first? How do we do it equitably?’ ” said David Aronoff, director of the division of infectious diseases at Vanderbilt University Medical Center.’

Experts differ over states’ CMCO non-compliance

‘Law experts differ on the refusal of some states to implement the conditional movement control order (conditional MCO) based on various interpretations of Article 81 of the Federal Constitution.

‘While lawyer Derek Fernandez said the states have a constitutional obligation to follow what has been gazetted as law by the Federal Government (if the states have yet to have their own laws on Covid-19), former judge Datuk Seri Gopal Sri Ram said it is not so simple.’

State v Federal impasse over lockdown relaxation order

‘Under the Federal Constitution (Article 81), state governments are obliged to make sure that states comply with federal law. Further, their action does “not impede or prejudice” the federal government’s authority.  In short, they must comply with regulations as these are part of federal law. Else it will be a violation of the state’s constitutional obligation. So, any abridgement of the federal law’s reach, or orders that are inconsistent with it, will constitute non-compliance.’

Defiance of the 9 States – The whirling wheels of Malaysian federalism

‘On 1st May 2020, Prime Minister Muhyiddin Yassin announced that the MCO would be substantially lifted come 4th May 2020. The MCO will hence be superceded by a Conditional Movement Control Order (CMCO).

‘In a stunning development, as many as 9 states have said they will not be following or complying fully with the Federal Government’s ease of movement and resumption of businesses at 100% capacity under the CMCO.

‘Is it unconstitutional for these States to not follow or fully comply with the Federal Government’s CMCO?’
